Terms and Conditions

These Terms and Conditions ("Terms") govern all purchases and use of digital services provided through the online shop of Fmfl Devteam ("Provider", "we", "us", or "our").

By placing an order through our shop, you agree to these Terms.


1. Scope

These Terms apply to all contracts concluded between the Provider and customers via our online shop regarding the purchase of digital content and digital services.

For the purposes of these Terms:

  • A consumer is any natural person entering into a legal transaction for purposes that are predominantly outside their trade, business, or profession (§ 13 BGB).

  • A business customer is any natural or legal person acting in the exercise of their commercial or self-employed professional activity (§ 14 BGB).


2. Subject Matter of the Contract

The Provider offers exclusively digital content and digital services.

No physical goods are shipped.

All services are provided on a prepaid basis.


3. Conclusion of Contract

The presentation of services in the shop does not constitute a legally binding offer.

By placing an order, the customer submits a binding offer.

A contract is concluded upon our acceptance or upon provision of the service.


4. Prices and Payment

All prices are final prices including statutory VAT where applicable.

Payment is due immediately upon conclusion of the contract.

Services are only provided after successful payment.

Payments may be processed via third-party providers, including PayPal.


5. Provision of Services

Digital services are provided electronically after payment.

Provision may be automated and immediate or within a reasonable timeframe.

Services are delivered using our hosting infrastructure and provisioning systems (including Pterodactyl Panel).


6. Right of Withdrawal (Consumers)

Consumers have a statutory right of withdrawal under German law.

The right of withdrawal expires for digital content and digital services if:

  • the customer has expressly agreed that performance begins before the withdrawal period expires, and

  • the customer has acknowledged that they lose their right of withdrawal upon commencement of performance.

This consent must be given explicitly during checkout.


7. Refund Policy

Refunds are excluded to the extent permitted by law once the service has been provided and the statutory withdrawal right has expired.

This does not affect mandatory statutory rights, including rights in case of defective performance.


8. Customer Responsibilities

Customers are responsible for:

  • providing accurate account and billing data

  • ensuring compatibility with their intended use

  • securing access credentials

  • maintaining independent backups of their data

We are not liable for data loss resulting from missing customer backups.


9. Backup and Snapshot Disclaimer

We may provide backup or snapshot functionality as a convenience feature.

Such backups are stored within the same infrastructure as the primary service and are not a substitute for an independent backup solution.

Customers remain solely responsible for maintaining external backups.

We do not guarantee the availability, integrity, or recoverability of snapshots or backups.


10. Acceptable Use and Abuse Prevention

We reserve the right to suspend or terminate services in cases of:

  • fraud or attempted fraud

  • payment disputes or chargebacks

  • abuse of services

  • violations of these Terms


11. Resource Usage Policy

Services operate within allocated resource limits.

Temporary usage peaks within allocated limits are permitted.

Sustained abuse of allocated resources or interference with system stability may result in restriction or suspension of services.


12. Liability

We are fully liable for intent and gross negligence.

For slight negligence, we are only liable for breaches of essential contractual obligations and limited to foreseeable damages.

Liability for injury to life, body, or health remains unaffected.


13. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany.

For consumers, mandatory consumer protection laws of their country of residence remain unaffected.


14. Severability Clause

If any provision of these Terms is invalid, the remaining provisions remain valid.
